Senator Brandon Smith Wants EPA Challenge

An eastern Kentucky lawmaker wants the Commonwealth to join with other coal-dependent states and challenge the federal EPA’s proposed new standards on greenhouse gas emissions. State Senator Brandon Smith is a Republican from Hazard.

He says the rules would have a devastating effect on a coal industry already ravaged by existing environmental policies. Smith made his comments at a hearing in Frankfort Thursday. He was speaking to Kentucky’s Energy and Environment Cabinet Secretary Len Peters…

Smith doesn’t believe the EPA’s new rules are “legitimate” because they were not approved by Congress. He questions the agency’s authority to limit emissions of carbon dioxide without Congressional action.
